A South Florida college student is asking an appeals court to recognize his same-sex marriage for the purposes of paying in-state tuition. 

Gildas Dousset says Florida's laws barring recognition of out-of-state same-sex marriages are unconstitutional.    He and his spouse legally married in Massachusetts last year. Dousset applied at FAU for in-state tuition as the spouse of a long-time Florida resident, but he says he was turned down because the school refused to recognize his marriage. 

No comment from administrators at Florida Atlantic University.
